1. Introduction
Welcome to Ayzex! These Terms of Service (“Terms”) govern your use of our platform, including purchases, design uploads, and marketplace interactions. By accessing Ayzex, you agree to comply with these Terms.
2. User Accounts
2.1 Registration
- Users must provide accurate information during signup.
- Multiple accounts by the same user are prohibited.
2.2 User-Initiated Termination
- Users can delete their accounts anytime if they have no active membership.
- If a user has an active membership, they must complete payment before account deletion.
- Once payment is cleared, users can delete their account (including card details) within 24 hours.
- If a user has used the membership for more than 24 hours after payment, deletion is not allowed until the next membership billing cycle.
- If a user unintentionally used the membership for 1-2 extra days, they may contact account-activity@ayzex.com for review.
2.3 Inactivity Policy
- Accounts inactive for 1 year may be permanently deleted.
3. Platform Policies
3.1 Policy Violations & Termination
- Users who repeatedly violate Ayzex policies will receive warnings before termination.
- Serious Offenses: Immediate account termination for:
- Copyright infringement (e.g., copying designs from brands, other platforms, or designers).
- Uploading illegal or offensive content.
- Appeals: Users may appeal wrongful terminations via account-activity@ayzex.com.
3.2 Legal Compliance
- If required by law enforcement, Ayzex may terminate an account after notifying the user unless legally prohibited.
4. Buyer Policies
4.1 Refunds & Returns
- Buyers must report defective or incorrect products to refund@ayzex.com within 48 hours of receiving the product.
- If reported within the time frame, Ayzex will arrange a refund or replacement.
- If a refund is requested, the product must be returned.
- Requests made after 48 hours will not be eligible for refunds.
4.2 Buyer Disputes & Indemnification
- Ayzex fully protects buyers in case of disputes related to product quality or incorrect orders.
5. Designer Policies
5.1 Design Ownership & Licensing
- Designers retain full ownership of their designs.
- By uploading a design, designers grant Ayzex a commercial license to sell it on the platform.
5.2 Copyright & Infringement
- Designers must not upload copyrighted content.
- If a designer’s work is copied, Ayzex will take action per Copyright Infringement Policy.
- Accounts with 200+ designs may receive a second chance for minor violations, but new accounts violating policies will be permanently banned.
5.3 Designer Indemnification
- If a third party files a legal claim against a designer for copyright infringement, Ayzex will provide legal support.
6. Payment & Pricing
- Prices are dynamic based on product type.
- Discounts may be offered at Ayzex’s discretion.
- Clear and transparent pricing policies ensure no hidden charges.
7. Liability & Indemnification
7.1 Platform Liability
- Ayzex takes full responsibility for all marketplace transactions.
- If a dispute arises due to Ayzex’s negligence, we will compensate affected users.
7.2 Ayzex’s Own Indemnification
- If an issue is caused by a third party, Ayzex will take necessary legal action.
8. Dispute Resolution & Jurisdiction
8.1 Resolution Process
- Users must first contact support@ayzex.com before taking legal action.
- Mediation and arbitration will be preferred over court cases.
8.2 Applicable Laws
- Ayzex follows the laws of its registered jurisdiction and complies with international trade regulations.
8.3 Legal Action
- Users should contact Ayzex before filing a legal case to resolve disputes amicably.
- The jurisdiction for legal actions will be determined by Ayzex’s registered location.
9. Policy Updates
- Ayzex will notify all users before making any policy changes.
- Notifications will be sent via email, in-app alerts, and dashboard notifications.
- Continued use of Ayzex after updates signifies user agreement with the new policies.
